NEWS: Ukraine’s proposed GMO law

This is to inform that Ukraine’s Ministry for Development of Economy, Trade and Agriculture has notified the World Trade Organization (WTO) regarding its proposed draft Law, “On State Regulation of Genetically Engineered Activities and State Control over the Circulation of GMOs and Genetically Modified Products to Ensure Food Security.”  The Draft law proposes to introduce a comprehensive legal and organizational framework for genetically engineered activities, including state control over the use and circulation of agriculture products containing genetically modified organisms (GMO). The draft also proposes measures for improving requirements for labelling of GM products and introduction of traceability rules.

It is unclear at this point if the draft Law will have any implications for Canadian exports to Ukraine. The Canadian Embassy in Kiev has reached out to the Ukrainian authorities for more details on the draft Law. While its adoption date is not specified, the notification states that it will enter into force following the day of its publication and enacted two years after its entry into force.

Please find below the WTO notification (G/TBT/N/UKR/188) for your reference, as well as an unofficial English translation of the draft Law.

Should you have any comments or questions regarding the proposed Law, please provide them to the Market Access Secretariat at aafc.mas-sam.aac@canada.ca by June 14, 2021.
